Know the Rules Before You Buy
Premium Cigars
Cigars that meet all five statutory criteria for premium are exempt from the California flavored tobacco restrictions and do not need to appear on the Unflavored Tobacco List.
The test covers more than price. The cigar must be handmade, wrapped in whole tobacco leaf, capped by hand, at least twelve dollars wholesale, and free of any filter or tip.
Everything Else Gets Checked
Little cigars and cigarillos move fast in value stores, but they do not qualify for the premium exemption. They are covered products and must appear on the list by brand style and UPC.
Check each item at utl.doj.ca.gov before you commit to a case. Non-listed product is subject to seizure, and the penalties land on you rather than your supplier.
Local ordinances can be stricter than state law, and some jurisdictions do not recognize the premium cigar exemption at all. Check your city and county rules before you stock.
