Premium Cigars Are Exempt
Most of what fills a tobacconist humidor sits outside the California flavored tobacco restrictions. A cigar that meets all five statutory criteria for premium does not need to appear on the Unflavored Tobacco List.
The test is handmade, wrapped in whole tobacco leaf, capped by hand, at least twelve dollars wholesale, and free of any filter or tip. All five, not just the price.
Watch the Edges
The line is narrower than it looks. A machine-made cigar, anything with a tip or filter, and cigars that fall under twelve dollars wholesale are all outside the exemption, along with little cigars and cigarillos.
Anything that does not qualify must be listed by brand style and UPC. Check it at utl.doj.ca.gov before it goes in the case.
Local ordinances can be stricter than state law, and some jurisdictions do not recognize the premium cigar exemption at all. Check your city and county rules before you stock.
